Commercial Manager / NEC4 Contracts Claims

The works include the design, supply and installation of a new a SCADA master station system, human machine interface (HMI), communication systems backbone and remote terminal units to replace and consolidate the existing life expired systems. I was appointed initially to review several high value claims against Network Rail, which the company had been struggling to progress resolution of on their design and build MF/1 (Rev 4) form of contract.

Resolution of a contractual dispute between SBC and their main contractor client, regarding numerous variation claims and a primary claim concerning a disputed trench width, which materialised post contract due to the vague wording of their bespoke design and build contract.

Resolution of contractual dispute between my client and Balfour Beatty Civil Engineering Ltd. Upon commencing their NEC3 contracts, my client found that methods of work envisaged at tender stage were no longer applicable, due to the changing physical condition of the ground, caused by abnormal weather conditions which ‘hard baked’ the site.

Resolution of contractual disputes between my client and Transport for London (TFL), concerning a £4 million framework contract procured under NEC3 Contracts Option A. The works involved minor civil works I.e. replacing nosing stones and tactile paving to numerous underground station.

Responsible for the delivery of three projects, namely the fire systems upgrade (NEC3 Contracts option A), Stanmore station final accounts (NEC3 Contracts Option A), and the communications and SCADA whole life contract - £50 million NEC4 Contracts Option C Target cost.

 

Balfour Beatty Rail Limited - Rail & Civils Major Works

BBRL were awarded the £35 million Gretna to Annan ‘track re-doubling’ project by Network Rail under an ICE Design & Build contract. The projects commercial team subsequently struggled to stay on top of contractual correspondence and manage change, I was appointed to help steer the project back on track.

 

AMCO Rail Limited - Rail & Civils Minor Works

I was appointed by AMCO when the company secured a new framework contract through Network Rail under a JCT Measured term contract worth approx. £5 million / year. A new team had been assembled who had little or no knowledge of contract procedures, and I was brought in to help steer the project while a permanent commercial manager could be appointed.
